Terms and Conditions of Purchase.

These terms and conditions apply to orders of ready-made artwork placed via this website only. For the specific terms and conditions relating to commissioned artwork please click here.

1) All items currently offered for sale on this website are original artworks by Nicki MacRae (unless specifically specified otherwise).

2) For most artworks, I use box frame stretched canvases with the staples on the rear of the frame for neatness. I pay great attention to the edges of my canvas which are either plain painted or sometimes have the design carrying onto the edges, therefore my paintings are ready to hang and require no framing. In the case of framed paintings, this will be clearly detailed along with details and images of the frame. Each painting is dated and signed on the rear, and is accompanied by a signed Certificate of Authenticity.

3) I accept payment by PayPal. You do not need a PayPal account – just enter your credit or debit card details when promoted. Should you wish to make a payment using a cheque (UK bank accounts only) then please get in contact with me. I do not dispatch goods until payment has been received (in the case of a cheque, when payment has cleared into my bank account).

4) The purchase price for any artwork shown in it’s listing, along with details of shipping costs. If shipping to your destination is not shown, please contact me with your location and a postal code / zip code for a bespoke quotation. Please note that prices shown on this website can change at any time without notice.

5) The purchase price paid by you will be that indicated at checkout.

6) I aim to dispatch all orders within 7 days. If this is not possible for any reason I will contact you via email or telephone to discuss when you might expect delivery before accepting and processing your order. All orders will be dispatched within 28 days of the order date, without exception.

7) Please note, when purchasing artworks you are purchasing the artwork itself and not any rights to replicate, reproduce or distribute the image.

8) If you wish to cancel your order you may do so (by email) at any time before the dispatch of your goods, or within 14 days of your receipt of the ordered goods. Your artwork(s) should be returned to the following address: N MacRae, Nicki MacRae Art, 2 Springfield, Morangie Road, Tain, Ross-shire IV19 1HR, UK. You will be liable for the postage cost to return the order. I ask that you inform me that this is your intention, via email, before returning the artwork(s), and take good care to package the artwork(s) carefully to ensure it (they) reach me in good condition. In these circumstances I will refund your payment (including any original delivery costs) via the original payment method as soon as possible – I will to do this within 14 days in all cases.

9) In the unusual circumstance that a delivery is lost in the postal system, all efforts will be made to locate and ensure delivery of the lost item(s). In the case that the lost commissioned artwork(s) are deemed to be unrecoverable, or after a period of 28 days (whichever is sooner), a full refund of payments made for the lost items and any associated shipping fee will be refunded.

10) I aim to have this website up to date with the correct availability for any artwork, however if for some reason a painting is unavailable at the time of ordering, I will cancel your order, notify you via email and process a full refund within 7 days of the date of your order.

Terms and Conditions – Commissioned Work.

These terms and conditions apply to orders of specially commissioned artwork, which are different to the Terms and Conditions for the purchase of ready-made work. For the Terms and Conditions relating to ready-made artwork purchased via this website, click here. 

1) Commissioned artwork is artwork that is custom-made for a client from scratch, on request, rather than bought ready-made ‘off the shelf’.

2) Communications about commissioned artworks will be carried out via email as a durable form of communication for the reference of both parties, and will clearly set out the details of the commision – the specifics of size, materials, content – and also clarify what will be left to the vision and methodology of the artist. It will set out estimated timescales for completion and delivery of the commissioned artwork(s), as well as the cost of the work, any additional applicable additional costs, any payment schedule, the applicable shipping fees and details of shipping timescales.

3) Discussion of the requirements of a commission and a quotation are a free of change service. If a commission requires detailed preparatory artwork or photographs or special research, this may be additionally chargeable however these charges will be clearly communicated and agreed upon, via email, by both parties prior to the Artist undertaking this work.

4) A contract for the commission and purchase of work will be considered agreed when: –
a) the Client agrees, via email, the written / visual details of the commissioned work,
and
b) the Client agrees the details of the price quotation (including shipping fees, if applicable);
and
c) the Client pays a deposit.
By completing these steps the Client is also agreeing to these Terms and Conditions.

5) The Client has a 14 day period, from the agreement of the contract to create the work (as detailed above), to cancel their order for the commissioned artwork(s). Work on the commissioned artwork will not commence during this ‘cooling off period’. If the Client wishes for work on the commissioned artwork to commence before this 14 day period has elapsed, the Client will confirm, via email, that they are wavering this right to cancel.

6) Specially commissioned artworks are not eligible for return and refund. The only exception is in the case of commissioned artwork(s) which are damaged in transit. If you should find your commissioned artwork has arrived with you in less than perfect condition, please contact me and we will work to rectify the situation to your full satisfaction (refund of the commission cost and shipping cost or repair of the damaged artwork, as appropriate and practicable).

7) Where commissioned artworks are lost in the postal system, all efforts will be made to locate and ensure delivery of the lost item(s). In the case that the lost commissioned artwork(s) are deemed to be unrecoverable, or after a period of 28 days (whichever is sooner), a full refund for fees charged for the commissioned artwork and associated shipping costs will be made.

8) In the case of commissions of artwork to be delivered outside the UK, it is the responsibility of the Client to pay any import taxes or local fees that become payable on import of the goods into their country of residence. The Client should satisfy themselves of the details of any charges that may be due before entering into a contract to commission artwork.
